VLG™ MOBILE APPLICATION PRIVACY POLICY

This privacy policy (“Privacy Policy”) describes how the VLG Mobile App (the “VLG App”) may collect, use and share information that we have obtained from or about you. This Privacy Policy describes our practices in connection with your use of the VLG App and any of the features, functionalities, or services available therein. By using the VLG App, you are consenting to the practices described in this Privacy Policy. “You,” “your” or “Customer” means and refers to you as a user and customer of the VLG App. “We,” “our,” “us” or “Company” refers to Natalie Espenship Enterprises, LLC.

The VLG App is not directed nor intended for individuals who are younger than the age of 18. We do not knowingly collect personal information from any individuals under the age of 18. 

BY ACCESSING OR USING THE SERVICES, YOU AGREE TO THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY AND YOU HEREBY CONSENT TO THE COLLECTION, USE, AND DISCLOSURE OF CERTAIN INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. YOU AGREE TO BE BOUND BY ALL PROVISIONS OF THE PRIVACY POLICY THAT ARE DISPLAYED ON THE VLG APP ON THE DATE YOU USE THE VLG APP. YOUR CONTINUED USE OF THE VLG APP INDICATES YOUR ACCEPTANCE OF ALL OF THE PROVISIONS OF THIS PRIVACY POLICY DISPLAYED ON THE VLG APP ON THE DATE OF SUCH USE. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU CANNOT USE THE VLG APP.

This Privacy Policy applies to Information we collect through the VLG App, and other electronic communications sent through or in connection with the VLG App. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy section below). Your continued use of the VLG App after we revise our Privacy Policy means you accept and consent to those changes, so please check the Privacy Policy periodically for updates.

TYPES OF INFORMATION WE COLLECT: 

When you use the VLG App, certain types of data may be collected from you, including: (1) Personal Information; and (2) Non-Personal Information (collectively referred to as “Information”). For more detailed information on the collection of Personal Information from individuals under 16, please refer to the How We Protect the Privacy of Children Online section below.

In order to view, access and use certain portions of the VLG App, and content displayed thereon, you may be required to disclose certain information that, either alone or in combination with other information, can be used to uniquely identify, contact or locate you (collectively, “Personal Information”). We may collect or receive the categories of Personal Information listed below, which may depend on material you access or use, and your device and account settings. 

  • Personal identifiers such as first and last name, email address, age, general location (city and state), and number of children; 

  • Account information, such as your username and password; 

  • Device and Online Identifiers, such as IP address, browser type, operating system, device model, device identifiers, and identifiers associated with cookies; 

  • Internet or other electronic network activity and web analytics, such as information about how you use, access, or interact with the VLG App, features used and time spent using the VLG App;

  • Any personal information that you voluntarily provide as part of user generated content, such as posts, comments and direct messages.

  • Records of communications with our customer support team.

HOW WE COLLECT INFORMATION (SOURCES OF INFORMATION): 


Information Provided Directly by Customers.

Customers actively provide information to Company in various ways while using the VLG App. For example, Customers share information when Customers:


  • Sign-up for the VLG App and create a profile, including by providing their name, age, general location and number of children;

  • Sign-up for the VLG App with their email address; 

  • Voluntarily post user generated content that includes their Personal Information;

  • Request customer service; or

  • Send us a message or contact us;

  • Opt-in to the collection of geolocation information. 

    • When a Customer expressly opt-ins to the collection of their geolocation information, in order to be connected with other users or services nearby.   


Information Collected From Our Service Providers, Vendors and Third-Parties.

Company may use contractors, vendors and other third-parties to assist in the provision of the VLG App and to improve the quality of the VLG App. We may obtain information about you from third parties, including from vendors and service providers who may collect information on our behalf, such as:

  • When you use the VLG App, open or click on emails we send you, or interact with the VLG App or advertisements therein, we, or third parties we work with, may automatically collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third-party libraries, and cookies.

  • Collecting data from other third-parties engaged by Company to improve the VLG App, such as analytics providers. We use analytics to understand how Customers engage with the VLG App, including:

    • Usage data: to see which features are most popular, how long Customers stay on the VLG App and how they navigate between different sections.

    • Device information: to ensure the VLG App is compatible with various devices and troubleshoot technical issues. 

Any information we obtain from third parties will be treated in accordance with this Privacy Policy. We are not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices. 

Automatically Gathered Information.

Company automatically tracks certain information about Customers based upon Customers behavior while using the VLG App. This information is used to better understand and serve Customers by responding to Customers particular interests and needs. 

Usage Details.

When you access and use the VLG App, we may automatically collect certain details of your access to and use of the VLG App, including traffic data, date and time you access the VLG App, content you viewed, the number of links you click within the VLG App, features used, time spent on the VLG App and any third-party website and sections within the VLG App that you access.

Device Information.

When you access the VLG App, we may collect information about your device and internet connection, including the device's unique device identifier, IP address, operating system, type of mobile device you use, browser type and network information.

Use of Cookies (or mobile cookies). 

Our VLG App may use cookies to enhance the user experience while using the VLG App. Cookies are pieces of information that some apps and websites transfer to the computer or mobile device that is browsing that app or website and are used for record-keeping purposes by many apps and websites. Use of cookies makes web browsing easier by performing certain functions such as saving your passwords, saving personal preferences regarding your use of the particular app or website, and ensuring that you don't see the same advertisement repeatedly. It may be possible to refuse to accept cookies by activating the appropriate setting on your device. However, if you select this setting you may be unable to access certain parts of the VLG App.

By continuing to use the VLG App, you are agreeing to our use of cookies. We may choose to use any or all of the following cookies:

  • Strictly necessary cookies. These are cookies that are required for the operation of the VLG App. They may include, for example, cookies that enable you to log into secure areas of the VLG App. 


  • Analytical/performance cookies. They allow us to recognize and count the number of users and to see how users move around the VLG App. This helps us to improve the way our system works, for example, by ensuring that users are finding what they are looking for easily.


  • Functionality cookies. These are used to recognize Customers when they return to the VLG App. This enables us to personalize our content for you and remember your preferences.


  • Targeting cookies. These cookies record your visit to the VLG App, the areas you have visited and the links you have followed. We may use this information to make the VLG App more relevant to your interests. 

Please note that third parties (including, for example, providers of external services like web traffic analysis services) may also use cookies, over which we have no control. 

Use of Web Beacons.

A “web beacon,” “clear GIF,” “web bug,” or “pixel tag” is a tiny graphic file with a unique identifier that is similar in function to a cookie, but allows us to count the number of users that have visited certain pages or screens of the VLG App, and for other related app statistics.

HOW WE PROCESS AND USE YOUR INFORMATION:

Generally.

We use your Personal Information for our business purposes including:

  • Providing and Supporting the VLG App:

    • Creating and maintaining your account and profile;

    • Allowing Customers to post, comments and engage with others on the VLG App;

    • Connecting Customers with other users and members of the “Village”;

    • Providing the functionality requested;

    • Operating and improving the VLG App’s functionality and user experience; 

    • Connecting Customers with nearby services and users; and 

    • other specific purposes for which you have given consent to the processing of your Personal Information.


  • Communicating with you about the VLG App:

    • Providing Customers with customer service and technical support;

    • Providing marketing and other commercial offers as further disclosed herein;

    • Sending administrative emails, such as password resets, policy updates and announcements; and

    • Responding to correspondence we receive from you directly, through our contact page; or otherwise.


  • Improve, monitor, personalize and protect the VLG App including:

    • Providing Customers with a tailored experience when using the VLG App;

    • Enhancing functionality of the VLG App;

    • Protecting the security and integrity of the VLG App and help prevent fraud;

    • Conducting analytics; 

    • Understanding your needs and interests, and personalizing your experience with the VLG App and our communications;

    • Troubleshooting, testing, and research, and keeping the VLG App secure; and

    • Investigating and protecting against fraudulent, harmful, unauthorized, or illegal activity.


  • Research and Development including:

  • Debugging;

  • Undertaking internal research for technological development and demonstration; and

  • Verifying or maintaining quality or safety or improving or upgrading the VLG App.


  • Compliance and Protection including:

    • We may use Personal Information to enforce compliance with our terms and policies, and to defend us against legal claims or disputes;

  • Protecting our, your or others’ rights, privacy, safety, or property (including by making and defending legal claims);

  • Auditing our internal processes for compliance with legal and contractual requirements and internal policies;

  • Compliance with a legal obligation;

  • Enforcing the terms and conditions that govern the VLG App; and

  • Preventing, identifying, investigating, and deterring fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

Some processing may also be necessary to comply with applicable laws, lawful requests and legal process, such as to respond to subpoenas or requests from government authorities, and other legal obligations such as to keep records of transactions.

Payment Information.

We use the App Store to process your payments. When you make a payment for the VLG App, your payment details (such as credit card number, billing address, and transaction details) are processed directly by the App Store. We do not store or have access to your payment information. 

Non-Personal Information.

We collect and create de-identified, anonymized and aggregated information and other non-personal information, which is not related to an identified or identifiable natural person (“Non-Personal Information”). You agree that Company owns, without restriction, all Non-Personal Information and that you have no rights in or to any Non-Personal Information. Because Non-Personal Information cannot be used to personally identify you, you agree we may use such information for any lawful purpose.


HOW WE DISCLOSE YOUR INFORMATION: 


Generally.

Except for disclosing your Personal Information to our third-party service providers and contractors in furtherance of Company’ business and/or commercial purposes as described herein, we do not sell, share, or otherwise transfer your Personal Information to third parties. We may disclose Personal Information that we collect, or you provide for the following purposes:

  • To service providers, contractors and other vendors we use to support our business and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them, such as analytic providers, app server hosts, email messaging providing and cloud storage providers.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Company’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Company is among the assets transferred.

  • To fulfill the purpose for which you provide it. 

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

We may also disclose your Personal Information:

  • To enforce or apply our EULA, or any other additional terms and conditions agreed to by Customer.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Company or others.  

As a general rule, beyond the uses set forth above that assist us in carrying out Company’s business and/or commercial purposes, and providing the VLG App requested by you, we will not sell or share your Personal Information to third parties without your permission. 

Legal Requirements.

As we may determine in our sole discretion, we may disclose Personal Information if required to do so by applicable law, including, without limitation, responding to a subpoena or request from law enforcement, court, or government agency, or in the good faith belief that such action is necessary to: (i) comply with a legal obligation; (ii) protect or defend our rights, interests or property or that of third parties; (iii) prevent, investigate, or identify possible wrongdoing in connection with the VLG App; (iv) act in urgent circumstances to protect the personal safety of customers, users or the public; or (v) protect against legal liability.  


HOW WE PROTECT THE PRIVACY OF CHILDREN ONLINE:

The VLG App is intended for use by parents and adults. No part of the VLG App is designed or intended to attract anyone under the age of 18. We will never ask for or knowingly collect information from children, if you are under the age of 18, you are not permitted to use the VLG App. Consistent with the Children's Online Privacy Protection Act, we will not knowingly collect any information from children. If you think that we have collected Personal Information from a child under the age of 18 through the VLG App, please contact us and we will dispose of the information.  

SENSITIVE DATA:

Company does not collect sensitive data. Sensitive data refers to data that includes details about race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, or information about health and genetic and biometric data. In addition, Company does not collect any information about criminal convictions and offences.

INFORMATION RETENTION:


We retain Personal Information for as long as needed or permitted in light of the purpose(s) for which it was collected. The criteria used to determine our retention periods include:


  • The length of time we have an ongoing relationship with you and provide the VLG App to you (for example, for as long as you have an account with us or keep using the VLG App) and the length of time thereafter during which we may have a legitimate need to reference your Personal Information to address issues that may arise;

  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or

  • Whether retention is allowed by applicable law (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).


When we no longer need to process your Personal Information for the purposes set out in this Privacy Policy, we will delete your Personal Information from our systems.

SECURITY:

Company uses technical, administrative, and physical measures to protect your Personal Information against accidental or intentional destruction, loss, alteration, unauthorized disclosure, or access and against other unlawful forms of collecting and processing. Company follows industry standards and practices to help protect the confidentiality and integrity of your Personal Information that is collected and processed. 

THIRD-PARTY SERVICES:

In general, the third-party service providers and contractors used by us, will only collect, use and disclose your Personal Information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers may have their own privacy policies. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your Information will be handled by these providers.

The VLG App may contain links to other websites, applications, and services maintained by third parties in which case the privacy policy of such third party applies and this Privacy Policy does not apply. The information practices of such other services are governed by the third-party privacy policies, which we encourage you to review to better understand those third parties’ privacy practices.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. Therefore, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

EMAIL AND MARKETING COMMUNICATIONS:

From time to time your Personal Information, such as your name and email address, may be used to contact you with promotional materials, newsletters, marketing or other information from Company, that may be of interest to you based on your preferences. You may be contacted by the e-mail address you provide to us.  We may contact you in this way based on our legitimate interest in undertaking marketing activities to provide you with the most up-to-date information on the VLG App and other products and services you may be interested in based on your preferences. By providing your contact information you have opted-in to receive direct marketing and commercial information by means of electronic email communication. You can withdraw your consent to receive any direct marketing communication from us by contacting connect@vlgapp.com or following the opt-out instructions in our email communications.

CAN-SPAM ACT:

We are committed to being compliant with the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 (“CAN-SPAM Act”). All e-mails you receive from Company are intended to fully comply with the CAN-SPAM Act. You can withdraw your consent to receive any direct marketing communication from us by contacting connect@vlgapp.com or following the opt-out instructions in our email communications.

YOUR ACCESS TO AND CONTROL OVER YOUR INFORMATION:

You have options about the various ways we collect, use and store your Personal Information. 

Log-in/Contact Us.

If you have created an account through the use of the VLG App, you may log in to your account to enter and update your own contact information. You can also contact us through one of the options provided in the Contact Us section at the bottom of this Privacy Policy. 

Consent: 

When you provide us with Personal Information through the VLG App we imply that you consent to our collecting it and using it to carry out Company’s legitimate business purposes.  

Opt-out: 

Consistent with applicable law, you may have the right to opt-out of having your Personal Information shared for purposes of email marketing. If you would like to exercise your right to opt-out please contact us using the information contained in the Contact Us section. You can also withdraw your consent to receive any direct marketing communication from us by contacting connect@vlgapp.com or following the opt-out instructions in our email communications.


ADDITIONAL JURISDICTION SPECIFIC RIGHTS – SUPPLEMENTAL NOTICE FOR CERTAIN STATE RESIDENTS


The VLG App is intended only for users in the United States. By accessing the VLG App, you agree and acknowledge that the VLG App is hosted in the United States and that Personal Information collected through the VLG App will be stored and processed in the United States. You use of the VLG App is governed by U.S. law, this Privacy Policy and our EULA. 

Your Rights Regarding Your Personal Information.

At this time, Company does not meet the applicability thresholds set by U.S. state consumer privacy laws, such as the California Consumer Privacy Act (CCPA), Colorado Privacy Act (CPA), and other similar state laws. As such, these laws do not currently apply to Company, and Company is not legally required to provide the rights outlined in them. However, we value your privacy and are committed to transparency. If you have questions about your Personal Information or would like to request access, correction, or deletion of any Personal Information you believe we may have collected, you may contact us using the information below. While we are not obligated to respond under applicable law, we may review and respond to reasonable requests at our discretion.

Do-Not-Track Disclosures; Third-Party Tracking.

The VLG App does not respond to “Do No Track” signals as this functionality was primarily designed for web browsers, not mobile applications. However, depending on your device and operating system, you may be able to limit certain tracking by adjusting your mobile device settings. 

Shine the Light Request. 

California Civil Code § 1798.83 permits residents of California to request from Company a notice disclosing: (1) the categories of Personal Information we have shared with third parties, if any, for the third parties’ direct marketing purposes, during the preceding calendar year, and (2) the names and addresses of those third parties. To submit a shine the light request, please contact us by using the contact details in the “Contact Us” section below.

CHANGES TO OUR PRIVACY POLICY:

We reserve the right to change the terms of this Privacy Policy at any time by posting those changes to this Privacy Policy, so that you are always aware of our processes related to collection, use and disclosure of your Personal Information. For significant changes, we will notify you by posting a prominent notice on the VLG App indicating when the Privacy Policy was most recently updated.  Please consult this portion of the VLG App regularly for important changes to the Privacy Policy as they occur.
